About the Project:
EmployInsure and its affiliated companies are building a next-generation employment risk solution designed to help California employers prevent and manage employment liability exposure. California employers face increasing pressure across employment practices liability (EPL), PAGA claims, wage and hour compliance, leave and accommodation obligations, and workplace investigations, and the cost of getting any of it wrong continues to rise.
We are assembling a small advisory team to design a practical, operational compliance and risk management framework that can be delivered as a service and product to employers. This engagement will work directly with our leadership team to translate California employment law requirements into operational HR processes, workflows, and tools that measurably reduce employer risk.
Key Responsibilities:
The right person for this engagement has been in the room when things went wrong, and has built the systems that prevented it from happening again. They understand the gap between what the law requires and what actually happens in the field, and they know how to close it.
California Compliance Subject Matter Expertise: Serve as the primary subject matter expert on California employment law as it applies to employer risk: wage and hour, meal and rest breaks, PAGA exposure and reform, retaliation and discrimination, leave laws (FMLA/CFRA/PDL), disability accommodation, and workplace investigations. Provide practical, operational guidance — not academic recitation.
HR Process Design: Design and document best-practice HR operational processes that form the foundation of a client-facing risk prevention program. Deliverables include: hiring and selection documentation standards, progressive discipline frameworks, complaint intake and reporting systems, investigation protocols, termination review checklists, leave and accommodation workflows, and final pay compliance processes.
Risk Pattern Analysis: Work with internal teams to analyze common employment dispute patterns, frequent client HR issues, PAGA litigation triggers, and operational compliance gaps. Translate findings into prioritized risk categories and map each to preventive processes and tools.
Framework Development: Build a structured California Employment Risk Framework, a defined, documented model that organizes compliance requirements, risk exposures, and prevention processes into a deliverable that can be implemented by employers and administered through Samuel Hale’s PEO and HR service infrastructure.
Product Collaboration: Partner with EmployInsure leadership to translate the risk framework into scalable service models, operational playbooks, training frameworks, and compliance tools. This work directly informs the product architecture of EmployInsure’s employment practices risk solution.
Deliverables:
By the conclusion of this engagement, the following are expected:
- A defined California Employment Risk Framework organized by risk category, regulatory exposure, and prevention pathway
- A structured set of documented HR compliance processes covering the full employment lifecycle from hire to termination
- Decision workflows and manager-facing tools for key employment risk scenarios (performance, accommodation, leave, separation)
- A repeatable, scalable model structured for delivery to employers through EmployInsure’s service platform
Ideal Background:
- 10+ years of HR leadership, consulting, or employment advisory experience; California-focused experience required.
- Deep, current knowledge of California employment law: Labor Code, PAGA, IWC Wage Orders, CFRA/PDL, FEHA, pay transparency, and multi-state overlap considerations.
- Demonstrated experience designing and implementing HR compliance processes in complex, multi-site, or multi-employer environments.
- Hands-on workplace investigation experience; able to assess investigation protocols for defensibility and design improvement.
- Background in one or more of the following environments strongly preferred: HR consulting firm, PEO or EOR organization, employment law firm (HR advisory side), or large California multi-state employer.
- Ability to translate legal and regulatory requirements into plain-language operational tools that managers and HR generalists can actually use.
- SHRM-SCP, SPHR, or equivalent certification preferred; EEOC Investigation Certification or California specialty HR credentials a plus.
Engagement Details:
This is an independent contractor engagement. The selected advisor will work directly with EmployInsure’s Director of Human Resources and executive leadership team on a project basis. Work is remote with collaboration via video, shared documentation platforms, and periodic working sessions. Engagement scope, timeline, and deliverable milestones will be defined in a Statement of Work prior to commencement.
